Howlitzer Terms of Service
Effective date: 28 September 2026
These terms are an agreement between you and Influensea Inc., a corporation registered in the State of Wyoming, USA (filing number 2022-001190656), with its mailing address at 6847 N 9th Ave, Ste A 324, Pensacola, FL 32504, USA ("Howlitzer", "we", "us"). They apply to the Howlitzer website, Howlitzer sign-in and the Howlitzer apps Conduit, Motion, QA, Library and Flow (the "Services").
By creating an account or using the Services, you accept these terms and our Privacy Policy. If you accept for an organisation, you confirm that you have authority to bind it, and "you" includes that organisation.
1. Who may use the Services
The Services are for businesses and professionals only. You may use them only in the course of your trade, business or profession, and not as a consumer. You must be at least 18 years old. You must give accurate details and keep them up to date.
2. Your account
- Keep your password and sign-in secure. Tell us at once at info@howlitzer.com if you think someone else has used your account.
- You are responsible for what happens under your account.
- An organisation may create and manage accounts for its staff. That organisation can see and control the content in its workspace.
3. Agencies, customers and brands
If you are an agency, you may register your customers and the brands they own, and act for them in the Services. When you do, you confirm that:
- each customer has authorised you to act for it, and to connect and publish to its accounts;
- the details you enter for it (legal name, country, registration number) are correct;
- you have the right to give us any personal data about your customers and their people, and you have told them how we use it (our Privacy Policy).
You are responsible to us for what you do for your customers.
4. Connecting social media accounts (Conduit)
Conduit publishes content to social media accounts that you connect. Conduit supports YouTube, X, Facebook and Instagram. We are adding TikTok, LinkedIn and Pinterest; Conduit does not offer them yet. We will add other platforms, and their terms, to this section before Conduit offers them.
- Only accounts you control. Connect only accounts that you own or are authorised to manage.
- You choose every post. Conduit publishes only content you submit, to the accounts you select, at the times you set. Before you submit, check what will be published, where and when.
- Platform terms apply. Your use of each platform through Conduit is also governed by that platform's terms, and you must follow them:
- YouTube: by using Conduit with YouTube, you agree to be bound by the YouTube Terms of Service. Conduit uses YouTube API Services.
- X: X Terms of Service.
- Facebook and Instagram: Meta Terms of Service, the Facebook Pages, Groups and Events Policies and Instagram Terms of Use.
- When Conduit offers them: TikTok Terms of Service, LinkedIn User Agreement and Pinterest Terms of Service.
- Your own content. Use Conduit to publish your own original content, or content you are authorised to publish, to accounts you own or manage. Do not use it to copy other people's content between platforms.
- Disclosing paid content. You must label sponsored, branded or paid content as each platform and the law require.
- Platform charges. Some platforms charge for each post. Conduit shows you the charge, and asks you to accept it, before you connect such an account.
- Platform decisions. A platform can limit, refuse or remove a post, or change or withdraw its API. Some platforms limit posts from new apps (for example, to private visibility) until they complete a review. We are not responsible for a platform's decisions.
- Removing access. You can remove Conduit's access to an account at any time in the platform's settings, or ask us to remove the connection at info@howlitzer.com.
5. Your content
"Your content" means anything you upload, link, publish or create through the Services, including videos, transcripts, captions, brand profiles and workflows.
- You own your content. We claim no ownership of it.
- Licence to us. You give us a worldwide, non-exclusive, royalty-free licence to host, copy, process, transform (for example, transcribe, cut and reframe) and transmit your content, only as needed to provide the Services to you. This includes sending it to the platforms you select and to the service providers listed in our Privacy Policy. The licence ends when your content is deleted from the Services, except for content you already published.
- No training. We do not use your content to train AI models.
- Your responsibility. You confirm that you have all the rights needed for your content, including the consent of the people who appear in it or are named in it, and that it does not break the law or anyone's rights.
6. AI features
QA and other features use AI models, including third-party models, to suggest moments, write draft posts and score clips. QA sends video frames and transcripts to those third-party models, as our Privacy Policy describes; it has no mode that avoids this. AI output can be wrong, incomplete, or similar to output given to others. Review it before you publish it. You are responsible for what you publish.
AI services you choose. You may use the Services with an AI service that you choose and that you contract for yourself: for example, your own Claude account, to which you add Howlitzer's connector, or your own API key. Your agreement with that AI provider governs how it handles the content and personal data it receives, and you are responsible for choosing a plan that allows your use.
- Our advice. For work for your business or your clients, use a business plan: Claude Team, Claude Enterprise or the Claude API. Do not use a personal plan such as Claude Free, Pro or Max. Anthropic's terms for personal plans do not allow commercial or business use in the European Union, the EEA and Switzerland, and personal plans include no data processing agreement.
- If you do not follow this advice. If you use an AI service or plan whose terms do not allow your use (for example, a personal plan for client work), you do so at your own risk. You will defend and indemnify us, and hold us harmless, against any claim, loss, fine or cost (including reasonable legal fees) that arises from that choice, including claims by your clients, by people whose data you sent to that service, or by the AI provider. This does not apply to a loss to the extent that our own breach of these terms, our breach of the law, or our negligence caused it.
7. Acceptable use
You must not use the Services to:
- break any law or any platform's terms;
- publish content that infringes rights, or that is unlawful, deceptive, hateful or harassing;
- publish spam, or automate posting in a way a platform forbids;
- impersonate anyone, or connect accounts you are not authorised to manage;
- attack, overload, probe or reverse-engineer the Services, or get around our security or limits;
- build a competing product.
We may remove content, or suspend access, that breaks this section.
8. Fees
The Services are currently provided in early access without charge. If we introduce fees, we will tell you in advance, and fees will apply only if you agree to them.
9. Early access
The Services are in early access. Access is by our invitation only, and we may end an invitation at any time. The Services may change, contain errors, or stop. We may add, change or remove features.
10. Suspension and ending
- You can stop using the Services at any time, and ask us to delete your account by writing to info@howlitzer.com (see the Privacy Policy, section 7).
- We may suspend or end your access if you seriously or repeatedly break these terms, if a platform or the law requires it, or to protect the Services or other users. Where reasonable, we will warn you first.
- When your account ends, we delete your data as the Privacy Policy describes. Content you already published on a platform stays there until you delete it.
- Sections 5 (Your responsibility), 11, 12, 13 and 15 continue after these terms end.
11. Disclaimers
We provide the Services "as is" and "as available". To the extent the law allows, we give no warranty, express or implied, that they will be uninterrupted, error-free or fit for a particular purpose, or that a platform will accept any post.
12. Limitation of liability
To the extent the law allows:
- we are not liable for any indirect or consequential loss, or for loss of profit, revenue, business, goodwill or data;
- our total liability to you for all claims arising out of or relating to the Services or these terms is limited to the greater of the fees you paid us in the 12 months before the claim arose and USD 100.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that the law does not allow us to limit.
13. Indemnity
You will defend and indemnify us against claims, losses and costs (including reasonable legal fees) arising from your content, your breach of these terms or of a platform's terms, what you do for your customers, or your choice of an AI service or plan (section 6).
14. Changes to these terms
We may change these terms. We post every change on this page. If a change is significant, we tell you by email or in the Services at least 30 days before it takes effect. If you continue to use the Services after that date, the new terms apply.
15. Governing law and disputes
These terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules. The state and federal courts located in Wyoming have exclusive jurisdiction over any dispute arising out of or relating to these terms or the Services.
16. General
These terms and the Privacy Policy are the whole agreement between you and us about the Services. If a part of them is invalid, the rest still applies. If we do not enforce a right, we do not waive it. We may transfer these terms as part of a reorganisation or sale of our business. You may not transfer them without our written consent. If we publish these terms in another language and the versions differ, the English version applies.
